1. About these terms

These terms and conditions (“terms”) govern your use of our website at thecaring.app and the tools and services we offer through it. Our services currently include, or will include as they launch:

  • the Care Funding Guide, including our assistant Seacole;
  • Care Journey, our guidance and planning tool for carers;
  • Life Timeline, our digital legacy and memory tool;
  • The Caring App, our care coordination tool for families and care circles; and
  • the website that connects these tools.

We refer to all of these together as the “services”. Some services are still in development and are shown as “coming soon”. They become available to you only when we launch them, and these terms apply to each service from the moment you start using it.

Please read these terms carefully. By using any of our services you agree to them. If you do not agree, please do not use the services.

2. Who we are and how to contact us

3. Who can use the services

You must be at least 18 years old to create an account or use the services. The services are intended for people in the United Kingdom. By using them you confirm that you are 18 or over and that the information you give us is accurate.

The services are designed for personal, non-commercial use by people arranging or thinking about care for themselves or someone they know. Please do not use them for any commercial purpose without our written agreement.

4. Your account and signing in

Some services need an account. We use a magic-link sign-in, so you sign in with your email address and we send you a secure link or code. You do not set a password.

You are responsible for keeping access to your email account secure, because anyone with access to it could sign in as you. Please tell us promptly at hello@thecaring.app if you think someone else has used your account.

When you sign in on our website and open one of our connected tools, we sign you in to that tool using your email, and create an account there for you if you do not already have one. This only happens when you deliberately open a tool. How we handle the data involved is explained in our Privacy and Data Protection Statement.

5. The services are information, not professional advice

This is important. Our services give you general information and help you organise and plan. They do not give you financial, legal, medical, or other professional advice, and they are not a substitute for advice from a qualified professional who knows your situation.

In particular:

  • The Care Funding Guide and Seacole provide general information about care funding in the United Kingdom. Seacole is an automated assistant powered by artificial intelligence. It can be wrong, incomplete, or out of date, and it does not know your full circumstances. Please check anything important with the relevant authority, such as your local authority, the NHS, or a qualified adviser, before you rely on it or make a decision.
  • Care Journey helps you think through your situation as a carer and gives you a general plan. It is guidance, not a clinical or legal assessment.
  • We are not a regulated care provider. We do not provide care, and we are not regulated by the Care Quality Commission.

You remain responsible for the decisions you make. To the extent the law allows, we are not liable for decisions you take based on information from the services. Always seek professional advice for your specific circumstances, and in an emergency contact the emergency services.

6. Content you provide

Some services let you enter, save, or upload content. This includes what you type into Seacole, what you save in Care Journey, the memories, text, photos, and voice notes you add to Life Timeline, and the updates, notes, tasks, and files you share in The Caring App.

You keep ownership of the content you provide. You grant us a limited licence to host, store, process, and display that content only as needed to provide the services to you and the people you choose to share it with, and to operate, secure, and back up the services. We do not use your content for advertising, and we do not sell it.

You are responsible for the content you provide, and you confirm that:

  • you have the right to provide it, and sharing it with us and your care circle does not break any law or anyone else's rights;
  • where your content includes information about another person, such as the person you care for or members of your care circle, you have a proper basis for sharing it and, where appropriate, you have told them or have their agreement. Please share only what is necessary, and please follow the guidance in each tool about not including details that identify a vulnerable person where they are not needed; and
  • your content is not unlawful, abusive, defamatory, or harmful.

We may remove content that breaches these terms or the law. Please keep your own copies of anything important to you, as the services are not a substitute for your own records or backups.

7. Acceptable use

When using the services you agree not to:

  • use them for anything unlawful, fraudulent, or harmful, or to harass, abuse, or harm anyone;
  • upload anything that is unlawful, infringing, or contains malware;
  • attempt to gain unauthorised access to the services, other users' accounts, or our systems;
  • copy, scrape, resell, or commercially exploit the services or their content without our written permission;
  • misuse Seacole or any AI feature, for example to attempt to extract training data, generate harmful content, or circumvent its limits; or
  • interfere with or disrupt the services or place an unreasonable load on them.

We may suspend or end your access if you break these rules.

8. Our content and intellectual property

The services, including their text, design, branding, software, and the information we publish (but not the content you provide), belong to us or our licensors and are protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable right to use the services for your own personal care planning while you comply with these terms. You may not copy, modify, distribute, or create derivative works from our content except as the services allow or the law permits.

“The Caring App”, “Care Funding Guide”, “Care Journey”, “Life Timeline”, “Seacole”, and our logos are our brand features. Please do not use them without our permission.

9. Availability, changes, and beta features

We are a small, growing service and we improve the services over time. We may add, change, suspend, or withdraw features, and some services are offered on an early or beta basis and may be less reliable. We try to keep the services available but we do not promise they will always be available or uninterrupted, and we may carry out maintenance or updates.

The services are currently provided free of charge. If we introduce paid features in future, we will set out clear pricing and any additional terms before you pay, and your statutory rights as a consumer will be unaffected.

10. Our responsibility to you

We provide the services with reasonable care and skill. Nothing in these terms limits or excludes our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud, or for any of your statutory rights as a consumer that cannot be excluded.

Subject to that, and because the services provide general information and we offer them free of charge:

  • we are not liable for any loss that was not reasonably foreseeable, for any business loss, or for loss arising from your reliance on general information when you should have taken professional advice; and
  • we are not responsible for the content of any third-party website or service we link to.

Nothing in these terms affects your rights under the Consumer Rights Act 2015 or other consumer protection law.

11. Suspending or ending your use

You can stop using the services at any time, and you can ask us to delete your account and data as set out in our Privacy and Data Protection Statement. We may suspend or end your access if you seriously or repeatedly break these terms, if we reasonably believe it is necessary to protect the services or other people, or if we stop providing a service. Where it is reasonable to do so, we will give you notice.

12. Your privacy

We take your privacy seriously. How we collect and use your personal data, the lawful bases we rely on, and your rights under UK data protection law are explained in our Privacy and Data Protection Statement, which forms part of your use of the services. Please read it alongside these terms.

13. Changes to these terms

We may update these terms from time to time, for example to reflect new features or changes in the law. If we make significant changes we will update the date at the top and, where appropriate, let you know. By continuing to use the services after a change, you accept the updated terms.

14. General

If any part of these terms is found to be invalid, the rest continue to apply. If we do not enforce a term straight away, we can still enforce it later. You may not transfer your rights under these terms to anyone else. We may transfer ours, for example if our business is reorganised, without reducing your rights.

15. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts, and the mandatory consumer protection law of the part of the UK where you live still applies to you.
